AGREEMENT BETWEEN USER AND MINISTRY OF JUSTICE

TERMS AND CONDITIONS OF WEBSITE USE

Effective Date: Wednesday 20th July, 2011

THESE "TERMS AND CONDITIONS OF WEBSITE USE" (this "User Agreement") govern your use of the Website (defined below), regardless of how you access or use it. The Website is provided by the Ministry of Justice without modification of the terms, conditions, and notices contained herein. Your use of the Ministry of Justice Website constitutes your agreement to all such terms, conditions, and notices.

By "Website", we mean the Internet domain address within which this User Agreement is posted and all features, applications, content, and downloads that are operated by us. The Ministry of Justice Website is comprised of various Web pages operated by Ministry of Justice.

EACH TIME YOU ACCESS AND/OR USE THIS WEBSITE, you agree to be bound by and comply with all of the terms of this User Agreement and any Additional Terms.  To the extent there is a conflict between this User Agreement and any Additional Terms, the Additional Terms will control unless the Additional Terms expressly state otherwise. Please also review the terms of the Website's Privacy Policy.

IT IS IMPORTANT THAT you read this entire User Agreement.  Please pay special attention to the following:  

◦Each time you use the Website, this User Agreement applies to your use. Any updates to it will apply to you and you should check frequently for any updates.

◦You may only use the Content on the Website in connection with your permitted activities on the Website and not for commercial or inappropriate purposes.

◦By using the Website, you will not obtain any ownership or intellectual property or other interest in it or any virtual or other items that may be used in connection with it.

◦Except as set forth in the Privacy Policy that applies to the Website, you and Ministry of Justice do not have a confidential, fiduciary, or any other special relationship by virtue of your use of the Website or your communications to Ministry of Justice through or related to the Website.

◦Ministry of Justice is providing the Website to you on an "as is" basis, without any warranty of any kind and liability to you in connection with your use of the Website is very limited.  Many other limitations and disclaimers relate to your use of the Website.

1.  Website Content, Ownership, Limited License, and Rights of Others.

A. Content. The Website contains a variety of materials and other items relating to the Ministry of Justice and its services, including information forms, media content, legislation, publications and statements from executives of the Ministry of Justice.

B. Ownership. The Website (including past, present, and future versions) and the Content are owned and controlled by the Ministry of Justice.   All rights, titles, and interest in and to the Content available via the Website is the property of the Ministry of Justice and is protected by Trinidad and Tobago copyright, trademark or other intellectual property rights and laws to the fullest extent possible. The Ministry of Justice owns a copyright in the selection, compilation, assembly, arrangement, and enhancement of the Content on the Website.

C. Limited License. Subject to your strict compliance with this User Agreement and the Additional Terms, the Ministry of Justice grants you a limited, non-exclusive, revocable, non-assignable, personal, and non-transferable license to download (temporary storage only), display, view, use, play, and/or print one copy of the Content on a personal computer, mobile phone or other wireless device, or other Internet enabled device (each, an "Internet Device") for your personal, non-commercial use only.  The foregoing limited license (i) does not give you any ownership of, or any other intellectual property interest in, any Content, and (ii) may be immediately suspended or terminated for any reason, in the sole discretion of the Ministry of Justice, and without advance notice or liability.

D. Rights of Others. In using the Website, you must respect the intellectual property and other rights of Ministry of Justice and others contained therein. Your unauthorized use of Content may violate copyright, trademark, privacy, publicity, communications, and other laws, and any such use may result in your personal liability, including potential criminal liability. The Ministry of Justice respects the intellectual property rights of others.

2.   Website and Content Use Restrictions.

A. Website Use Restrictions. You agree that you will not: (a) use the Website for any commercial purpose (b) use any meta tags or any other "hidden text" utilizing any Ministry of Justice trademarks or trade names; (c) engage in any activities through or in connection with the Website that seek to harm or attempt to harm any individuals or entities or are unlawful, offensive, obscene, lewd, lascivious, filthy, violent, threatening, harassing, or abusive, or that violate any right of any third party, or are otherwise objectionable to Ministry of Justice; (d) reverse engineer, decompile, disassemble, reverse assemble, or modify any Website source or object code or any software or other products, services, or processes accessible through any portion of the Website; (e) engage in any activity that interferes with a user's access to the Website or the proper operation of the Website, or otherwise causes harm to the Website, Ministry of Justice, or other users of the Website; (f) interfere with or circumvent any security feature of the Website or any feature that restricts or enforces limitations on use of or access to the Website or the Content or (g) otherwise violate this User Agreement or any Additional Terms.

B. Content Use Restrictions. You also agree that, in using the Content you will not modify, reproduce, archive, sell, lease, rent, exchange, create derivative works from, publish by hard copy or electronic means, publicly perform, display, disseminate, distribute, broadcast, retransmit, circulate to any third party or on any third-party website, or otherwise use or exploit such Content in any way for any purpose except as specifically permitted by this User Agreement or any Additional Terms or with the prior written consent of an officer of Ministry of Justice.   

3.  User-Generated Content.  Except as otherwise specifically described in the Website's Privacy Policy or any Additional Terms, your relationship with the Ministry of Justice is not a confidential, fiduciary, or other type of special relationship and anything submitted by you (such as any questions, comments, correspondence and the like) will be treated as non-confidential and non-proprietary User-Generated Content regardless of whether you mark them "confidential", "proprietary", or the like. Ministry of Justice will not assume any responsibility, obligation, or liability for the receipt or non-receipt of any of the foregoing.

4.  Mailing List information.

The Website's practices governing any collection and use of your personal information are disclosed in its Privacy Policy. Your decision to provide this information is purely voluntary and optional; however, if you elect not to provide it, then you may not be able to access certain Content.

If you register for any feature that requires your name and electronic mail address, you agree that:

a. You will not use a username (or e-mail address) that is already being used by someone else, belongs to another person, violates the intellectual property or other right of any person or entity, or is offensive. We may reject the use of any password, username, or email address for any other reason in our sole discretion.

b. You will provide accurate, current, and complete registration information about yourself in connection with the registration process and, as permitted, to maintain and update it continuously and promptly to keep it accurate, current, and complete for as long as you use the features to which the registration relates.

c. You are solely responsible for all activities that occur under your account, password, and username, whether or not you authorize the activity.   

5.  Links by You to the Website.

We may grant you a limited, non-exclusive, revocable, non-assignable, personal, and non-transferable license to create hyperlinks to the Website, upon request, so long as: (a) the links only incorporate text, and do not use any trademark graphics that are owned or licensed to Ministry of Justice, (b) the links and the content on your website do not suggest any affiliation with Ministry of Justice or cause any other confusion, and (c) the links and the content on your website do not portray Ministry of Justice  or its products or services in a false, misleading, derogatory, or otherwise offensive matter, and do not contain content that is inappropriate, that is unlawful, offensive, obscene, lewd, lascivious, filthy, violent, threatening, harassing, or abusive, or that violate any right of any third party or are otherwise objectionable to Ministry of Justice. Ministry of Justice reserves the right to suspend or prohibit linking to the Website for any reason, in its sole discretion, without advance notice or any liability of any kind to you or any third party.

6.  Linked-To Websites

The Website may contain links to or from third-party websites ("Linked Websites").  Ministry of Justice may have no control over the content, operations, policies, terms, or other elements of Linked Websites, and Ministry of Justice does not assume any obligation to review any Linked Websites. Any activities you engage in in connection with any of the same are subject to the privacy and other policies, terms and conditions of use, and rules issued by the operator of the Linked Websites. Ministry of Justice disclaims all liability in connection therewith.

7.  DISCLAIMER OF REPRESENTATIONS AND WARRANTIES

YOUR ACCESS TO AND USE OF THE WEBSITE IS AT YOUR SOLE RISK.

THE WEBSITE IS PROVIDED ON AN "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, MINISTRY OF JUSTICE HEREBY DISCLAIM AND MAKE NO REPRESENTATIONS, WARRANTIES, ENDORSEMENTS, OR PROMISES, EXPRESS OR IMPLIED, AS TO:

  • THE WEBSITE AND ALL ITS CONTENTS;
  • THE FUNCTIONS, FEATURES, OR ANY OTHER ELEMENTS ON, OR MADE ACCESSIBLE THROUGH, THE WEBSITE;
  • WHETHER THE WEBSITE OR THE SERVERS THAT MAKE THE WEBSITE AVAILABLE ARE FREE FROM ANY HARMFUL COMPONENTS (INCLUDING VIRUSES, TROJAN HORSES, AND OTHER TECHNOLOGIES THAT COULD ADVERSELY IMPACT YOUR INTERNET DEVICE); AND
  • WHETHER ANY DEFECTS TO THE WEBSITE WILL BE REPAIRED. 

UNDER NO CIRCUMSTANCES WILL MNISTRY OF JUSTICE BE RESPONSIBLE OR LIABLE FOR ANY LOSS OR DAMAGES OF ANY KIND, INCLUDING PERSONAL INJURY OR FOR ANY DIRECT, INDIRECT, ECONOMIC, EXEMPLARY, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL LOSSES OR DAMAGES THAT ARE DIRECTLY OR INDIRECTLY RELATED TO:

  • THE WEBSITE;

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE Ministry of Justice WEBSITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Ministry of Justice MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE Ministry of Justice WEB SITE AT ANY TIME. ADVICE RECEIVED VIA THE Ministry of Justice WEBSITE SHOULD NOT BE RELIED UPON FOR PERSONAL, MEDICAL, LEGAL OR FINANCIAL DECISIONS AND YOU SHOULD CONSULT AN APPROPRIATE PROFESSIONAL FOR SPECIFIC ADVICE TAILORED TO YOUR SITUATION.  Ministry of Justice MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE Ministry of Justice WEBSITE FOR ANY PURPOSE.

8.  General Provisions.

A. Updates to User Agreement. Ministry of Justice reserves the right to modify this User Agreement and any Additional Terms, at any time without prior notice ("Updated Terms"). Your use of the Website after we post the Updated Terms (or engaging in such other conduct as we may reasonably specify) constitutes your agreement to the Updated Terms. Therefore, you should review this User Agreement and any Additional Terms on a regular and frequent basis. The Updated Terms will be effective as of the time that Ministry of Justice posts them on the home page of the Website, or such later date as may be specified in them.

B. Applicable Law. This User Agreement and any Additional Terms will be governed by and construed in accordance with the laws of the Republic of Trinidad and Tobago.

C. Indemnity. You agree to, and you hereby, defend, indemnify, and hold Ministry of Justice harmless from and against any and all claims, damages, losses, costs, investigations, liabilities, judgments, fines, penalties, settlements, interest, and expenses (including attorneys' fees) that directly or indirectly arise from or are related to any claim, suit, action, demand, or proceeding made or brought against Ministry of Justice or on account of the investigation, defence, or settlement thereof, arising out of or in connection with: (i) your use of the Website and your activities in connection with the Website and (ii) your breach or anticipatory breach of this User Agreement or any Additional Terms. 

D. Severability; Interpretation. If any provision of this User Agreement, or any Additional Terms, is for any reason deemed invalid, unlawful, void, or unenforceable by a Court of competent jurisdiction, then that provision will be deemed severable from this User Agreement or the Additional Terms, and the invalidity of the provision will not affect the validity or enforceability of the remainder of this User Agreement or the Additional Terms (which will remain in full force and effect).
